Clemson City Council Special Election

Clemson, SC (June 19, 2012) – The City of Clemson has received an opinion by both the City Attorney and the Municipal Association of SC Senior Field Services Manager that Mr. Jeff Bennett and Mr. John Ducworth III did not meet the requirements for candidate filing in the City Council Special Election scheduled for June 26th, 2012.

This opinion is a result of the South Carolina Supreme Court decision clarifying the filing procedures for candidates to run for Municipal Council or Mayor to require a candidate to complete a Statement of Economic Interest (SEI) form online with the SC Ethics Commission and then file a paper copy of the SEI with the City Official accepting candidate filings. The two candidates did not file the paper copy with the City Official at the time they filed to be a candidate. As a result, the two candidate’s names are not eligible to appear on the ballots. There is no provision in the law that would allow candidate filing to be re-opened for this election.

The Pickens County Registration & Elections Commission wants to make certain voters are aware the election will take place as scheduled. Voters will have to write-in the name of the candidate they wish to vote for. Voters can write-in any person who meets the requirements of the office, including individuals whose names could not appear on the ballot because they did not file correctly.
